1. Introduction & Website Use
By booking a workshop with South Devon Nature Photography (“we”, “us”, “the Guide”), or by using this website, you (“the Client”, “you”) agree to the following terms and conditions.
1.2. Eligibility: You must be at least 18 years of age to book a workshop. If booking for a minor, you must be their legal parent or guardian.
2. Booking, Payment & Changes
2.1. A booking is confirmed only upon receipt of full payment .
2.2. All bookings are for the specific date and time stated. While we aim to be flexible, we cannot guarantee a change of date once booked.
2.2. Payment Methods: We accept payments via Credit/Debit Card, PayPal, or Apple Pay. All prices are in GBP (£).
2.3. Right to Amend: We reserve the right to change or withdraw any part of our website offering, including workshop details or prices, at any time prior to a confirmed booking.
3. Health, Safety & Physical Ability
3.1. Physical Requirements: You acknowledge that our workshops usually involve walking on rugged terrain that could be steep and/or slippery. You commit to honestly describing any personal physical limitations in our Health & Fitness Declaration as soon as possible after the booking is made, and that any companions booked onto the course with you will do the same.
3.2. Failure to Disclose: Failure to complete the Declaration at least 72 hours before the workshop may result in the workshop being cancelled and no refund given.
3.3. Safety Instructions: You agree to follow all safety instructions provided by the Guide. Failure to do so may result in your immediate exclusion from the workshop without a refund.
4. Equipment, Clothing & Warranties
4.1. Footwear: Stout, gripped footwear (e.g., hiking boots or good walking shoes) is necessary for the full outdoor experience. We reserve the right to refuse participation to anyone wearing unsuitable footwear (e.g., flip-flops, sandals, or smooth-soled trainers) with no refund given, unless we have specifically agreed an indoor or sheltered location well in advance of the day.
4.2. Clothing: You are responsible for bringing adequate waterproof and warm clothing.
4.3. Camera Gear: You are solely responsible for the safety and insurance of your own photographic equipment. We accept no liability for damage caused by salt spray, moisture, impact, or falls.
4.4. Warranties: While we provide professional guidance, we give no warranty regarding specific photographic outcomes, weather conditions, or wildlife sightings. The website is provided on an "as is" basis without any warranty of completeness or accuracy.
5. Intellectual Property & Copyright
5.1. Our Content: All text, images, and designs on this website are the intellectual property of South Devon Nature Photography and are protected by UK Copyright law. You may not copy or reproduce any content without written permission.
5.2. Client Images: You retain copyright over any photographs you take during the workshop.
5.3. AI Prohibition: You are strictly prohibited from using any website content for the purpose of training artificial intelligence or machine learning models.
6. Weather & Cancellations
6.1. Weather Policy: Workshops proceed in all weathers unless a Met Office warning is in place or the Guide deems the excursion too hazardous.
6.2. Our Cancellations: If we cancel due to weather or Guide illness, you will receive a 100% refund or a priority transfer to a new date. We are not liable for your travel or accommodation costs.
6.3. Client Cancellations: Please refer to our Booking & Refund Policy for specific notice periods and charges.
6. Limitations of Liability
6.1. In accordance with the Unfair Contract Terms Act 1977, we do not exclude or limit liability for death or personal injury caused by our proven negligence.
6.2. We are not liable for any indirect losses, loss of data (e.g., memory card failure), or damage to personal property.
7. Data Protection (GDPR)
7.1. We collect personal and medical data solely for your safety. This data is stored securely and will not be shared with third parties, except for emergency services if required.
7.2. Medical data is destroyed 7 days after the workshop concludes.
8. Governing Law
These terms are governed by the laws of England and Wales.
